Drive Danger Out

Ensuring Workplace Safety: A Vital Imperative

At Consult CPK, we prioritise workplace safety as a fundamental aspect of our consulting services. A recent case investigated by the Health and Safety Executive for Northern Ireland (HSENI) underscores the critical importance of adhering to proper safety procedures in the workplace.

Latest Prosecution Result: A Wake-Up Call

Peter O’Hare, the director of a County Down-based construction company, was fined £12,500 at Craigavon Crown Court following an incident where a worker sustained serious injuries. On 12 November 2022, a male employee was severely injured when struck by a reversing lorry driven by O’Hare. The accident occurred while they were attempting to retrieve a forklift truck stuck in uneven ground at the company’s premises.

The Importance of Proper Safety Procedures

Sophie Pearson, an inspector with HSENI’s Major Investigation Team, emphasised that this incident was entirely avoidable. Proper workplace transport controls, including adequate instruction, information, and effective communication, are essential to prevent such accidents. The failure to implement these controls can lead to severe consequences, both for the individuals involved and the organisation.

Findings of the Investigation

HSENI’s investigation revealed that Peter O’Hare failed to take reasonable care for the health and safety of his employees. Specifically, he did not ensure that others were in a place of safety while he reversed the lorry. Regular and thorough checks should have been conducted to ensure that all personnel were out of harm’s way.

Managing Workplace Transport Risks

Effective management of workplace transport risks involves three main principles:

  1. Safe Site: Ensure effective segregation of vehicles from pedestrians to prevent accidents.
  2. Safe Vehicle: Use the most appropriate vehicle for the task and environment.
  3. Safe Driver: Ensure that those operating vehicles are competent and exhibit safe behavior.

Legal Requirements and Further Information

Adhering to these principles not only ensures compliance with legal requirements but also fosters a safer working environment. More information on managing workplace transport can be found on the HSENI website, including details on the ongoing ‘Drive Danger Out’ campaign.

Conclusion

At Consult CPK, we believe that the correct safety procedures are not just a legal obligation but a moral one. Ensuring the safety of all employees should be a top priority for every organisation. By following established safety protocols and fostering a culture of safety, we can prevent accidents and protect our most valuable asset—our people
