In a recent investigation by the Health and Safety Executive for Northern Ireland (HSENI), Colinwell Masonry Products Limited, a company based in Dunmurry, has been fined for failing to ensure the safety of its employees. This case underscores the critical importance of adhering to health and safety procedures in the workplace.

Latest Prosecution Result

At Lisburn Magistrates Court, the company was fined £1,000 after pleading guilty to a health and safety offence. During an inspection on 24 May 2023, HSENI identified three locations within the premises where employees could access dangerous moving parts of machines and equipment.

HSENI Inspector, Kevin Campbell, emphasised the responsibility of employers to safeguard their workers:

“Employers have a legal duty to ensure employees and others are not put at risk from unguarded machinery. Serious incidents can result where workers can access dangerous areas due to inadequately maintained safety features or intentional bypassing of these features. HSENI will not hesitate to recommend the prosecution of companies who repeatedly fail to provide safe working conditions for their employees.”

Safety Failures and Their Consequences

The inspection revealed that access gates to onsite machinery lacked effective safety interlocking mechanisms. These mechanisms are crucial as they are designed to stop machines from operating when the gates are opened. Specifically, one gate had no interlocked safety feature, while the interlock mechanisms on two other gates were either defeated or broken. This failure meant employees could inadvertently access dangerous moving parts, posing a significant risk of injury or even fatal accidents.

As a result, HSENI issued three Prohibition Notices, preventing specific parts of the plant from operating until adequate safety measures were implemented. Notably, this was not the first incident at the premises; HSENI had previously issued seven similar Prohibition Notices.
